David Gibbs, stood up and addressed those present at First Baptist Church of Hammond Indiana Wednesday evening  service.

David Gibbs, said he was going to be performing a thorough investigation about everything going on at Hammond.

David Gibbs said that anyone who was abused come forward to the church, Gibbs didn’t tell those who were abused to go to the police. 

First of all, no matter how much hype you hear about David Gibbs, fighting for Christian Liberty, most of Gibbs practice has been as a defense attorney for pastors and others who physically, or sexually abused children in churches, Christian Schools and Independent Fundamental Boarding Homes.  Gibbs defended a former pastor who was convicted for tax fraud.

Not only does David Gibbs, defend the person accused, Gibbs works for the specific church to minimize damages, both civil and otherwise.  The word “church” I refer to here, isn’t the Universal church (all Christians) but the specific church entity involved or associated with where the offenses took place.

As a defense attorney, Gibbs job is to get information to have Gibbs client, (in this case, Jack Schaap) charges dismissed, reduced, or if those options aren’t successful, to try to ensure that his client to receive the lightest sentence possible.

I, Chuckles, spoke to a prosecutor friend this morning.  He was kind enough to point out the following:

First of all, in this case, both local and federal law enforcement agencies are the agencies the victims and anyone who has information pertinent to this case need to be the ones contacted.

Once law investigations are complete, David Gibbs will be given copies of law enforcement reports,  and any other findings, reports and evidence by the prosecutor’s office.

The Defense Attorney, (Gibbs) will want to conduct his own investigation.  Gibbs, or an individual called a defense investigator.  A defense investigator works for the defense attorney on the behalf of the accused. 

My prosecutor friend warned, “The defense, like the police, may electronically record conversations without the victims knowledge or consent. Defense attorney’s or defense investigators, like police investigators, may legally use deception to obtain information. A victim of a sexual offense who wants no contact with a defense investigator may simply notify the defense investigator orally or in writing. If you are a victim of a sexual  offense, after this notification the defense attorney or the defense investigator may not attempt further contact with [the victim]  unless the victim initiates the contact.

My prosecutor friend went on to say that law enforcement and the prosecutor’s office should be notified of what Gibbs said that night.  He said that if Gibbs has already been in contact with any alleged victims, those victims need to end all conversation with Gibbs, NOW, and inform law enforcement that they as a victim are being contacted by Schaap’s defense attorney.

Victims, don’t fall for the line “He [Gibb’s] is a Christian.”  Do NOT trust David Gibbs, Jr, or David Gibbs, III.  You will live to regret it.  As the victim, you’re  not Gibbs client, Jack Schaap and First Baptist Church of Hammond are his clients.

Victims of Schaap who trust Gibbs will live to regret it.

Ask Bob Gray victims. Ask New Bethany Survivors.

Ask Tina Anderson.

Gibbs legal duties as a defense attorney are with his clients. Victims are not Gibbs clients.

    I agree, they will not act to help the victims. See this excerpt of a post from the mother of two of Bob Gray’s victims:

    “You must be kidding, where does God give a time limit on when his wrath will come. I believe part of his judgement is coming now. And for the record it wasn’t thirty years for my girls, more like 20 when we first talked with the Pastor and Willinger. We got in touch with the Church because I really trusted them to do the right thing, I mean after all they “are Christians” and have taught us over the years right from wrong! They sent Gibb’s II and Gibb’s III, a retired detective and some lady to our house over 5 hours away. We thought it was a good thing and they were on our side, after all this man molested my daughters! They( Messer & Lillinger) admitted to me and my husband they knew about what Gray had done but retired him and sent him to Germany for the “sake of the Church and the Cause of Christ”. I was so upset I told Willinger he had NO RIGHT to take a criminal matter into his own hands….it wasn’t just a “sin” he could ask forgiveness for. I don’t believe God forgave him anyway,he didn’t turn away from his sin, he did it over and over again. And another thing for the record until my girls told me about what Gray had done we didn’t know “any” of the viticms and had moved away years before….we knew nothing of it, they thought they were the only victims. Stop kicking your wounded bothers and sister’s in Christ! Why don’t the good Christian men get a backbone and stand-up for whats right instead of closing your eyes, your ears, your voice> GET A BACKBONE! ”

    Another victim of Bob Gray wrote this about Gibbs:

    “Tony I agree with you. I wouldn’t level the church. But, what does need to happen is the congregation needs to stand up and clean house. There are alot of wonderful people that go to Trinity Church, school and college. The problem is they are still being lied to. If you go on Trinity’s web site the general counsel that is giving advise and comes accross as if they want to get to the bottom of everything has known about this for years. He’s not independant counsel he’s part of the cover up. The congregation can’t even access their pastors and leaders right now under his advice. If they only knew how deep this runs they would run out of there. To give you an example, look at his bond amount. Someone with a little marijuana or a DUI would get that. It’s sooooooo deep people don’t have a clue. My prayer is that God will open their eyes and show the congregation the truth and not have them wait for it to be dragged out of the leadership in court!!!!!”


  2. TRUST and respect MUST BE EARNED; We should be ready to love others but NOT place trust in people–including those who profess to be Christians–without KNOWING that they are worthy of trust. An attorney serves on behalf of his/her client, not the victims of that client.

  3. This is such an urgent matter that it has gone to the point of Christians versus law enforcement. It would be nothing for FBC and Schaap’s legal team to have him shipped off to Germany or Argentina, and the matter swept under the rug. Schaap’s legal team will be pervasive in demanding that victims come forward to the church FBC WILL NOT DO THE RIGHT THING! THE CHRISTIAN DEFENSE WILL NOT DO THE RIGHT THING! At this point, nobody working under the guise of christianity should be trusted! this is not a slam on christianity, it is the experience of a survivor who gave christians the benefit of the doubt, and was denied justice. This is a matter of law, and the prosecution of a crime.

  5. You know nothing of Gibbs or the incident at FBC Hammond. First of all, Gibbs is there to make sure things are done right…not to give Schaap any kind of “break.” It’s bad and hurtful enough without your “outside looking in” play-by-play commentary. You don’t go to FBC Hammond and I doubt you know anyone who can give you any credible information because unless you are on staff you probably don’t know fine details about anything.

    Look, I’m sorry someone hurt your feelings or you got ticked at preaching at some point, but grow up, learn your facts, and stop pushing false rumors about Independent Fundamental Baptist churches and matters.

    • Right there Elisha, we know nothing of Fibbs…er….Gibbs. Absolutely nothing. The way Gibbs is handling this situation is completely different than the 100’s of other incidents Gibbs has tried to “fix’. Yeah…sure.
      Fine details?….bah!

      Gibbs is the attorney of record for Schaap and FBC Hammond. For him to even suggest that victims come to him is a complete breach of ethics. One attorney (or even one firm) CANNOT advise both defendants and plaintiffs. By suggesting people come to him, I believe Gibbs may be in some deep water with the Indiana bar and legal system. It can easily be viewed as a conflict or even obstruction.

      Victims with questions need to contact the Lake County Sheriff. Whether or not you choose to believe Schaap is innocent is up to you. All anecdotal evidence points to cover ups at FBC Hammond.

    • I don’t see ONE word of sympathy for the victim – just defense of Schaap and Gibbs. You’ve been drinking the cool aid for too long. Gibbs is a typical lawyer – he will defend someone knowing they are guilty. One just has to look at Schaap on Youtube and see he’s a raving lunatic. The IFB are full of perverts. Do you think thousands of women have just made up stories about IFB people molesting them because they have nothing else to do? You need to take a serious look at what you’re involved with and get out of there and help as many people as you can.

    We realize that this incident with Schaap has emotions running high on all fronts. At this point, we don’t know how deep it goes (frankly, the “odd” request by Gibbs looks like an attempt to cover that up to some degree). The facts and the truth will come out … so let’s leave the prosecution to Lake County and the State of Indiana (unless it goes further up the food chain). And try to remember that none of this escapes God’s sight no matter what it looks like … FBC Hammond did at least one thing right – they fired him. Now we’ll see what comes of it all.


  7. Just like Chuck Phelps, these David Gibbs Lawyers claiming to be for the truth are the best at cover ups besides Chuck Phelps, himself.

    You know how much truth they are out to get when they imply and tell Chuck Phelps and his church and everyone for that matter that Chuck Phelps is innocent of an obvious cover up of a girl named Tina Anderson that the rapist protector Chuck Phelps protected was covicted of 5 felonious counts of Rape. Hmmmn what do you think Chuck is that stupid, no but that evil!!!!

    The Gibbs couldn’t tell the truth if you paid them in large amounts of unmarked cash, They practice talking like a caring Christian but and they even sound real good but in the end when you judge their outcome, like the Chuck Phelps “Cover Up” you soon realize lying and deceiving along with ambulance chasing is their real expertise!

  8. I have practiced law at CLA/Gibbs Law Firm under both David Gibbs Jr. and David Gibbs III in the past and I would still be practicing for them if I had not moved to another jurisdiction. In my first hand experience, they are credible, honest men of integrity and they live out their Christian beliefs.

      So you are saying they never asked other potential Schaap victims to come see them as opposed to telling them to go to the Law Enforcement Authorities? That act alone is grounded in questionable ethics for any officer of the court.
